That is the typical response you would expect from someone living in PA, NY, OH, MD, VA, WV. Unfortunately, the afternoon of August 23, 2011 removed any doubt about the possibility of an earthquake in those states when a 5.9 quake in central Virginia shook half of the East coast.
Both State and Federal governments have tried for years to more clearly define who is an employee and who is an independent contractor. On October 13, 2010 the Construction Workplace Misclassification Act was signed into law in Pennsylvania and provides clear criteria (along with fines and penalties) for how to decide who can be paid on a 1099 and who needs to be on your payroll.
What Are These New Criteria under the Act?
